Welcome to Onni Outdoor. These Terms of Service ("Terms") govern your use of our website www.onni-outdoor.com.au and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms.

Onni Outdoor ("Onni", "we", "us", "our") is an Australian-owned online retailer specialising in men's performance underwear. We operate from Australia and sell primarily to customers in Australia and New Zealand.

2. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted or modified by agreement.

Under the ACL, our products come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

3. Products and descriptions

We make every effort to ensure that product descriptions, images, sizing information and pricing on our website are accurate and up to date. However, we do not warrant that product descriptions or other content on our site are error-free, complete, or current.

Colours displayed on our website may vary slightly from the actual product due to differences in screen settings and display technology. Minor variations in fabric pattern or colour between batches may also occur and are a natural characteristic of the manufacturing process.

4. Pricing and payment

All prices on our website are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable.

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you place your order.

Payment must be made at the time of purchase using one of the accepted payment methods displayed at checkout, which may include credit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, and Shop Pay.

All transactions are processed securely through Shopify Payments. We do not store your full credit card details.

5. Orders and acceptance

Placing an order on our website constitutes an offer to purchase the products. An order is not accepted until we send you an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product information, or suspected fraudulent activity.

If we cancel your order after payment has been taken, we will issue a full refund to your original payment method.

6. Shipping and delivery

We offer free shipping Australia-wide on all orders. For full details on shipping timeframes and delivery information, please refer to our Shipping Policy.

Risk of loss and title for products passes to you upon delivery of the items to the shipping carrier. We are not responsible for delays caused by the shipping carrier or circumstances outside our reasonable control.

7. Returns, refunds and the First Pair Guarantee

We offer a 30-Day First Pair Guarantee on your first Onni purchase — if you're not satisfied, we'll provide a full refund even if the product has been worn and washed. For full details, please refer to our Return and Refund Policy.

Your rights under this policy are in addition to your rights under the Australian Consumer Law. We will never ask you to waive your consumer guarantee rights.

8. Intellectual property

All content on our website — including but not limited to text, images, product photos, logos, graphics, icons, and page layout — is the property of Onni Outdoor or our content suppliers and is protected by Australian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, or use any content from our website for commercial purposes without our prior written consent.

The Onni name and logo are trademarks of Onni Outdoor. Unauthorised use of our trademarks is prohibited.

9. User conduct

When using our website, you agree not to:

  • Use our website for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to our systems, accounts or data
  • Interfere with or disrupt the operation of our website
  • Submit false or misleading information, including fraudulent orders
  • Use automated systems (bots, scrapers) to access our website without permission
  • Post or submit content that is defamatory, offensive, or infringes on the rights of others

We reserve the right to terminate your access to our website if you breach these Terms.

10. Reviews and user-generated content

When you submit a product review, photo, or other content to our website, you grant Onni Outdoor a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, and display that content for the purposes of operating and promoting our business (for example, displaying your review on our product page or sharing it on social media).

You retain ownership of any content you submit. You represent that any content you provide is your own, is accurate, and does not infringe on the rights of any third party.

11. Limitation of liability

To the maximum extent permitted by law (and subject to your rights under the Australian Consumer Law which cannot be excluded), Onni Outdoor's total liability to you for any claim arising from or related to these Terms or your use of our website shall not exceed the total amount paid by you for the relevant order.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our website or products.

12. Disclaimer

Subject to your rights under the Australian Consumer Law, our website is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of our website or the accuracy or completeness of any information, content, or materials available on it.

13. Dispute resolution

If you have a dispute or complaint about our products or services, we encourage you to contact us first at admin@onni-outdoor.com.au so we can attempt to resolve the matter directly.

If we are unable to resolve the dispute, you may refer the matter to the relevant consumer affairs agency in your state or territory, or to the Australian Competition and Consumer Commission (ACCC) at www.accc.gov.au.

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

15. Changes to these Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of our website after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
